The Shops and Establishment Act is state-level legislation that governs the working conditions of employees in commercial establishments — offices, shops, hotels, restaurants, entertainment venues, and other places of commercial activity — in India. Each state has its own version of the Act, but most follow a broadly similar pattern of requirements.
Who Does the Shops and Establishment Act Apply To?
The Shops and Establishment Act applies to establishments that are not factories under the Factories Act. This includes offices of all types — corporate offices, bank branches, BPO operations, IT companies, retail stores, and hospitality establishments. Most large office complexes in Indian cities are registered under the relevant state Shops and Establishment Act.
Notice and Display Requirements Under the Act
Most state Shops and Establishment Acts require the registration certificate to be displayed prominently in the establishment. Working hours, rest intervals, and leave entitlements must be posted for employees. In some states, the Act requires that safety and welfare information be displayed in a language understood by the majority of employees.
Fire Safety Requirements for Commercial Offices
Regardless of the Shops and Establishment Act requirements, commercial offices in India must comply with fire safety regulations under the state fire services act and fire NOC conditions. Fire exit route maps, fire extinguisher location signs, assembly point signs, and no smoking notices are standard requirements for fire NOC compliance in commercial office buildings.
